LAND USE AND REAL ESTATE

Our lawyers represent the interests of real estate developers and individuals in land ownership and development matters.

Successful land use representation requires both a complete understanding of the relevant legal, intergovernmental, and political environments, as well as a sensible, results-oriented approach. BDPP’s lawyers help clients navigate the dynamic regulatory situation with concern to land use, planning, and zoning issues related to the acquisition, financing construction, management and potential disposition of real estate projects. We have assisted clients in major developments, such as regional malls and community shopping centers, office buildings, warehouse and industrial facilities, residential projects, mixed use projects, planned unit developments (PUDs), and affordable and workforce housing communities. We also have assisted clients in smaller but important projects, such as the approvals needed by a homeowner to build a pier or the approvals needed by a school to build athletic facilities.

The services we provide in the land use and real estate practice area are all inclusive. We can assist and advise on all zoning issues, such as the uses allowed in the residential, commercial, industrial, maritime, mixed use, open space, and small business zoning districts and the regulations and conditions relating to those uses. We can also assist and advise on issues relating to the Odenton Growth Management Area Districts and the Town Center Districts. We are well versed in critical area law and waterfront provisions, bog protection law, commercial revitalization areas, nonconforming uses, parking and signage issues, zoning violations and enforcement, re-zonings, special exceptions, and variances. We assist clients in meeting the requirements for re-zonings, special exceptions, and variances by presenting a persuasive case before the hearing officer that the proposed use meets all requirements of the law.

We assist clients on subdivision and site development issues by helping to obtain plan approvals; organize community meetings; seek required modifications from the law; meet adequate public facility, landscaping, forest conservation, and storm water management requirements; obtain grading and building permits; and monitor the fees paid in the development process. We have significant experience with historic sites and requirements relating to such natural features as steep slopes, floodplains, streams, and wetlands.

We handle appeals to the Board of Appeals by presenting a comprehensive and persuasive case. We also handle appeals to the circuit court from the decision of the Board of Appeals and appeals to the Maryland Appellate Courts.

ENVIRONMENTAL LAW

Environmental issues are an integral part of our land use and real estate practice. We assist clients in critical area law; bog protection law; securing permits under federal, state, and County law; compliance with regulations promulgated by the United States Environmental Protection Agency, the Maryland Department of the Environment, the United States Army Corps of Engineers, and the Maryland Critical Area Commission; and defending environmental enforcement actions. We also assist lenders, sellers, and purchasers in analyzing potential environmental problems affecting the sale or acquisition of real property.

 

CIVIL LITIGATION

Blumenthal, Delavan, & Williams, P.A. has a team of experienced trial lawyers. We handle cases in state and federal trial courts, federal and state appellate courts, and administrative agencies.

We handle virtually all types of civil litigation, with an emphasis on land use cases, real property issues, regulatory and environmental litigation, waterfront disputes, and business disputes. We have litigated a wide range of cases, including cases relating to title issues; covenants; community association disputes; construction disputes; contract disputes; fraud claims; condemnation; and receiverships.

We are lobbyists and strong advocates for our clients’ positions at all levels of government, including with the Maryland General Assembly, the Anne Arundel County Council, the Annapolis City Council, and all departments, agencies, boards, and commissions. We are knowledgeable about the legislative process and maintain good relationships with decision makers. We have been instrumental in the adoption of numerous Code revisions that reflect changes needed by our clients in the constantly evolving development marketplace.
